OSTP Seeks Input on Regulatory Reform to Support AI Innovation

 

The White House Office of Science and Technology Policy (OSTP) has issued a Request for Information (RFI) seeking public input on federal regulations, policies, and administrative processes that may hinder the development, deployment, and adoption of artificial intelligence (AI) technologies in the United States. 

The RFI, released as part of the Administration’s America’s AI Action Plan, invites perspectives from industry, academia, state and local governments, and other stakeholders on how existing laws and procedures might be modernized to better align with the capabilities of AI systems.  

OSTP’s initiative recognizes that most federal regulatory frameworks were developed before the emergence of modern AI systems and may rest on assumptions about human-operated decision-making that are not easily applied to autonomous learning technologies. The RFI identifies five broad categories of potential barriers: 

  • Regulatory mismatches, where existing requirements assume human supervision or static processes; 

  • Structural incompatibilities, where legal constructs make it difficult to accommodate AI systems; 

  • Lack of regulatory clarity, where uncertainty about coverage or enforcement discourages adoption; 

  • Direct hindrances, where existing rules explicitly limit AI use; and 

  • Organizational factors, such as limited agency capacity or workforce readiness. 

 

The information gathered through this RFI will inform OSTP’s coordination with federal agencies to identify opportunities for regulatory modernization, guidance development, and pilot programs to support safe, beneficial AI deployment.
